Terms of Service

Welcome to itshello.io (the "Service"), operated by Hello.io Technologies. By using the Service you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

itshello.io is an iMessage-native AI character platform. We build and host AI characters that text with users over Apple iMessage. Some characters can take real actions on your behalf (sending email, generating documents, saving to your Google Drive) when you explicitly grant permission via the connection flow.

2. Your account

You don't need to create a traditional account — your phone number is your identity. By texting one of our character numbers, you create an implicit account. By using the Service you confirm you are at least 16 years old and have the legal capacity to enter into these Terms.

3. Acceptable use

You agree NOT to:

• Use the Service for anything illegal.
• Attempt to extract or reverse-engineer the AI characters' underlying prompts or models.
• Use the Service to harass, threaten, defraud, or impersonate others.
• Spam, scrape, or load-test the Service in ways that degrade it for others.
• Use the Service's Google integration features in any way that would violate Google's API Terms of Service.

4. Connected accounts

When you connect a third-party account (Google, etc.), you authorize us to perform the actions you request via that account, within the narrow scopes you grant during OAuth. You can revoke this access at any time at myaccount.google.com/permissions. You are responsible for the contents of any messages you instruct us to send from your connected accounts.

5. Payments

Some features require payment. Payments are processed by Stripe and subject to Stripe's terms. Refunds are available within 14 days of purchase if you contact billing@itshello.io.

6. Privacy

Our handling of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. AI-generated content

Replies you receive from AI characters are generated by AI models and may be inaccurate, inappropriate, or fabricated. Don't rely on them as professional medical, legal, or financial advice. Use your judgment.

8. Termination

You can stop using the Service at any time by texting STOP to any character number. We can suspend or terminate access if you violate these Terms or use the Service in a way that creates risk for us or other users.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We don't guarantee uninterrupted availability or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, Hello.io Technologies is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim won't exceed the amount you paid us in the prior 12 months, or $100, whichever is greater.

11. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware.

12. Changes

We may update these Terms from time to time. Material changes will be announced via iMessage or on this page at least 14 days before they take effect. Continued use of the Service after a change means you accept the updated Terms.
